Terms of Sale

These Terms of Sale (“Terms”) govern the purchase and use of the Deskmode Suite plugin (the “Software”) and related updates and support (the “Services”) from3WEB

1. Definitions

  • Software: the Deskmode Suite WordPress plugin, in its free and/or premium versions.
  • License: the right to receive downloads, updates and support for a number of websites and for the period you purchased.
  • License Key: the code that activates updates and support for your sites.
  • Order: your purchase of a License on the Site.

2. The product and the GPL license

The Software is WordPress software and its code is licensed under the GNU General Public License (GPL) v2 or later. Under the GPL you may use, modify and redistribute the Software’s code. What you purchase from us is not a restriction of those code rights, but a commercial License that grants you access to official downloads, automatic updates, and support, tied to a License Key and to the number of sites in your plan.

3. Orders, account and payment

3.1 To buy a License you must provide accurate billing information and, where required, create an account.
3.2 Payments are processed by Paypal. Where Paypal acts as merchant of record, it is the seller of record for that transaction and its terms also apply.
3.3 An Order is confirmed once payment is authorised and you receive an order confirmation by email.

4. Prices and taxes

4.1 Prices are shown on the Site and may change at any time; changes do not affect Orders already placed.
4.2 Prices are stated EXCLUSIVE of VAT. Applicable taxes are calculated at checkout based on your location and added or shown as required by law.

5. License grant, activation limits and permitted use

5.1 Subject to payment, we grant you a non-exclusive License to receive updates and support for the Software on up to the number of websites indicated by your plan (e.g. 1, 5, or unlimited sites).
5.2 The License Key must not be shared or resold to obtain updates/support for sites beyond your plan.
5.3 You are responsible for keeping backups and for testing updates in a staging environment before production.
5.4 Nothing here limits your rights under the GPL to the Software’s code.

How the licence works:

Without a licence -the plugin activates none of its features until you enter the key.

On expiry – the version you have keeps working, without updates or support; versions released after your expiry date require a renewal.

If you remove the key – the features switch off, but your settings stay saved and come back as soon as you enter it again.

6. Updates and support

6.1 An active License includes automatic updates and support for the period purchased (typically 12 months).
6.2 Support covers installation help, bug fixes and general questions about documented features, via email. It does not include custom development, third-party conflicts we do not control, or work on your server.
6.3 We may end support for older versions of the Software or for versions of WordPress/PHP no longer supported by their vendors.

7. Renewals and cancellation

7.1 Licenses are sold for a fixed term and, where offered, may renew automatically to keep updates and support active.
7.2 You can cancel automatic renewal at any time from your account or by contacting [email protected]; cancellation takes effect at the end of the current term.
7.3 If a License expires or is cancelled, the Software keeps working on your sites; you simply stop receiving updates and support until you renew.

8. Refunds — 14-day money-back guarantee

8.1 We offer a 14-day money-back guarantee from the date of purchase. If the Software does not work as described and we cannot resolve the issue, contact [email protected] within 14 days for a full refund. 8.2 Refunds may be refused in cases of abuse (e.g. obtaining a refund after clearly having used the Software in production for the intended one-off purpose, or repeated refund requests).
8.3 Where exist an external merchant of record, refunds are processed under its policy, consistent with this guarantee.

9. Right of withdrawal (EU consumers) and digital content

9.1 The Software is digital content supplied electronically. For EU/EEA consumers, the statutory 14-day right of withdrawal for digital content is lost once the download/delivery begins, provided you have given prior express consent and acknowledged that you thereby lose the right of withdrawal.
9.2 By downloading the Software or receiving your License Key you give that consent and acknowledgement. Our voluntary money-back guarantee in Section 8 applies regardless and is more favourable.

10. Intellectual property

10.1 The Software’s code is GPL. Our trademarks, brand name “Deskmode”, logo, website content and documentation are our property and are not licensed under the GPL; you may not use them to imply endorsement or to pass off derivative products as ours.
10.2 You may not use our License Keys, update servers or support in a way that breaches these Terms.

11. Warranty disclaimer

The Software is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law, including fitness for a particular purpose and non-infringement. We do not warrant that the Software will be uninterrupted or error-free or compatible with every theme, plugin or server. Mandatory consumer warranties that cannot be excluded by law are not affected.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of data, profits or business, arising from the use or inability to use the Software or Services. Our total liability for any claim shall not exceed the amount you paid for the License in the 12 months before the claim. This does not exclude liability that cannot be limited by law (e.g. death or personal injury caused by negligence, or fraud), nor mandatory consumer rights.

13. Acceptable use

You must not use the Software or Services to break the law, infringe third-party rights, or attempt to circumvent License limits, update servers or security.

14. Termination

We may suspend or terminate your License and access to Services if you materially breach these Terms (for example, License Key abuse). Termination does not affect the GPL rights to code already in your possession.

15. Changes to these Terms

We may update these Terms; the version in force at the time of your Order applies to that Order. Continued purchases after changes constitute acceptance of the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of Italy. The courts of Messina have jurisdiction, without prejudice to mandatory consumer protections in your country of residence. EU consumers may also use the European ODR platform: https://ec.europa.eu/consumers/odr
